Acceptable Use Policy

1. Permitted Uses

You may use the prompts and generated images for:

• Personal creative projects and self-portraits
• Social media content creation and personal branding
• Commercial use — selling prints, merchandise, and licensed images
• Client work — generating imagery for paying clients
• Marketing materials, website visuals, and brand content
• Editorial and artistic projects
• YouTube thumbnails, podcast covers, and digital media

2. Strictly Prohibited Uses

You may not use the prompts or generated images to:

• Produce content intended to harass, defame, threaten, or harm any individual or group
• Create misleading or fraudulent imagery — including fake news images, political disinformation, or impersonation of real public figures in deceptive contexts
• Generate content that promotes, glorifies, or incites violence, terrorism, or hate crimes
• Produce content that discriminates against or demeans individuals based on race, religion, gender, sexuality, disability, nationality, or any other protected characteristic
• Create imagery that violates the intellectual property rights of third parties
• Redistribute, resell, or share the prompt files themselves — in whole or in part
• Use the prompts to train, fine-tune, or build competing AI models or prompt datasets

3. Your Responsibility for Generated Content

Sparko AI Lab provides the prompts only. You are solely responsible for the images you generate, how you use them, and ensuring they comply with:

• The terms of service of the AI platform you use
• All applicable laws in your country and the countries where you publish or distribute generated images
• The privacy and publicity rights of any individuals whose likeness appears in generated images

5. Real Individuals & Celebrity Likeness

Some prompts in this pack may reference real-world settings, arenas, or scenes associated with public figures or celebrities. Any such prompts are provided for creative inspiration only. You acknowledge and agree that:

• You are solely responsible for ensuring generated images comply with the platform policies of whichever AI tool you use
• You are solely responsible for ensuring generated images comply with all applicable laws in your country and the countries where you publish or distribute them
• You will not publish or commercialise AI-generated images depicting real, identifiable individuals without their explicit consent
• Sparko AI Lab does not endorse, encourage, or accept liability for the generation or distribution of images depicting real individuals

6. Fictional Characters & Copyrighted IP

You may not use the prompts to deliberately reproduce the appearance of copyrighted fictional characters. This includes but is not limited to:

• Marvel Entertainment / Disney — Spider-Man, Iron Man, Thor, Captain America, Black Panther, Wolverine, and all Marvel characters
• DC Comics / Warner Bros. — Superman, Batman, Wonder Woman, The Flash, Aquaman, and all DC characters
• Cartoon Network / Warner Bros. — Ben 10, and all Cartoon Network original characters
• Any other animated, comic book, video game, or film character owned by a third-party IP holder

This applies regardless of whether the character's name appears in the prompt. If a generated image is recognisably a copyrighted character by design — through a deliberate combination of colours, costume, symbols, or distinctive features — that constitutes potential copyright and trademark infringement and is your sole legal responsibility. Sparko AI Lab accepts no liability for images generated in violation of third-party intellectual property rights.

7. Face Reference Images

When using a face reference photo with our prompts, you confirm that:

• You have the right to use that person's likeness (it is your own face, or you have explicit permission)
• You will not use another person's face reference without their knowledge and consent
• You will not use the prompts to generate deceptive or harmful content featuring another person's likeness

8. Platform Compliance

Different AI platforms have their own content policies. It is your responsibility to ensure your use of our prompts complies with the rules of whichever platform you use. Sparko AI Lab is not responsible for content removed or accounts suspended by third-party AI platforms.

9. Enforcement

Sparko AI Lab reserves the right to revoke your licence to use this product immediately and without refund if we become aware of a violation of this policy. Serious violations — particularly those involving minors or non-consensual intimate imagery — will be reported to relevant law enforcement authorities in India and internationally.

10. Reporting a Violation

If you become aware of someone misusing content generated with our prompts, or if you wish to report a concern, please contact us at support@sparkoailab.com

11. Governing Law

This policy is governed by the laws of India, including the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, and the Indian Penal Code where applicable.
